Is it true that in 2010 you have to get a 3 ton a/c unit to replace your broken one?

my a/c went on the fritz this summer, finally got them to put r-22 in it, after telling me that as of jan. 1, 2010 I can't get it anymore and that I would have to buy a 3 ton unit to replace it per the clean air act. my house is only 926 sq ft, sounds like overkill and scare tactics to a single woman. any help and info would be appreciated.
